Why Won't (Alt/Click) choose a color???

so when using brush can use (alt/click) choose color, other times overlapping arrow icon , won't select color. what's going on? using ps cs 2.

details needed.  clicking?  bitmap layer targeted?

 

exact version of cs2?  platform, mac or win? exact version of os, etc.
